Welcome to Digixpot.com (the “Site”). These Terms of Service (“Terms”) govern your access to and use of the services provided by Digixpot (“we,” “us,” or “our”). By purchasing a subscription or using our services, you agree to be bound by these Terms.
1. Services & Subscriptions
Digixpot provides “on-demand” expert teams and digital products.
- Managed Teams: We provide vetted professionals (Designers, Developers, SEO Specialists, etc.) integrated into your workflow within 48 hours of onboarding.
- Productized Services: Services are sold as flat-rate subscriptions or fixed-price digital assets.
- Service Limits: While we offer “unlimited” revisions on many plans, work is processed sequentially. Only one active task is worked on at a time unless your specific plan allows for multiple concurrent “slots.”
2. Payments & Merchant of Record
Our order process is conducted by our online reseller Paddle.com.
- Merchant of Record: Paddle is the Merchant of Record for all our orders. They provide all customer service inquiries and handle returns.
- Billing: You will be billed in advance on a recurring basis (monthly or annually) depending on your selected plan.
- Currency: Payments are processed in the currency selected at checkout.
3. Intellectual Property Rights
- Deliverables: Upon full payment of all fees due, the Client owns all rights, titles, and interests in the final creative deliverables produced during the subscription period.
- Pre-existing Materials: Digixpot retains ownership of any proprietary tools, AI workflows, or base code used to generate deliverables, granting the Client a non-exclusive license to use them as part of the final work.
4. Cancellation & Pause Policy
- Cancel Anytime: You may cancel your subscription at any time through your billing dashboard or by contacting support. Access to services will continue until the end of your current billing period.
- Pause Feature: Some plans allow you to “pause” your subscription. Remaining days in a billing cycle will be held as credit for future use.
5. Refund Policy
Due to the digital nature of our services and the immediate allocation of expert resources:
- General Rule: We generally do not offer refunds once a billing cycle has begun or work has commenced.
- Satisfaction Guarantee: If you are unsatisfied with the quality of work, we will provide unlimited revisions until the output meets the project brief.
- Paddle Disputes: As the Merchant of Record, Paddle handles final refund determinations for billing errors or unauthorized charges.
6. Feedback & Communication
To maintain our 48-hour launch and delivery speeds, Clients must provide timely feedback. Digixpot is not responsible for delays caused by the Client’s failure to provide necessary assets, access, or approvals.
7. Limitation of Liability
To the maximum extent permitted by law, Digixpot shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services. Our total liability is limited to the amount paid by the Client in the three (3) months preceding the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Digixpot is registered, without regard to conflict of law principles.
